1. About Snappy Tutor

A.C.N. 696 839 933 Pty Ltd (trading as Snappy Tutor) (“we”, “us”, “our”) operates an online marketplace platform located at snappytutor.com.au that connects students and parents (“Students”) with independent tutors (“Tutors”).

Snappy Tutor is a platform only. We do not employ tutors, provide tutoring services ourselves, or guarantee the quality, safety, or suitability of any tutor listed on our platform.

2. Acceptance of Terms

By accessing or using Snappy Tutor, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

3. Platform Role and Limitations

3.1 Snappy Tutor is an introduction service only. We connect Students with Tutors but are not a party to any tutoring arrangement made between them.

3.2 We do not supervise, direct, or control the tutoring services provided by Tutors.

3.3 Any tutoring agreement, including fees, lesson times, location, and delivery method, is made directly between the Student and the Tutor.

3.4 Snappy Tutor is not responsible for the conduct, actions, or omissions of any Tutor or Student.

4. Tutor Obligations

By registering as a Tutor on Snappy Tutor, you agree to the following:

4.1 Working With Children Check (WWCC)

If you provide tutoring services to anyone under the age of 18, you are legally required to hold a current and valid Working With Children Check (or equivalent) issued in your relevant Australian state or territory. By ticking the WWCC self-declaration on your profile, you confirm that you hold such a check.

This declaration is self-reported. Snappy Tutor does not independently verify Working With Children Check status. You bear full legal responsibility for compliance with child safety laws in your state or territory. You agree to notify Snappy Tutor immediately if your WWCC expires, is suspended, or is cancelled.

Providing a false WWCC declaration is grounds for immediate account suspension and may constitute a criminal offence under applicable Australian law.

4.2 ID Verification

Tutors may optionally complete ID verification via Stripe Identity for a one-off $5 AUD fee. Successful verification earns a “✓ Verified” badge on your profile.

Important: The ID Verified badge confirms that Stripe Identity has verified your identity document. It does not constitute a background check, criminal history check, Working With Children Check, or any assessment of your suitability to work with children or in any other capacity.

The $5 AUD verification fee is non-refundable once the verification process has been initiated. If verification fails, you may attempt verification again by paying the fee again.

4.3 Accuracy of Information

All information provided on your profile, including qualifications, experience, subjects taught, and WWCC declaration, must be accurate and truthful. Providing false or misleading information is grounds for immediate account suspension.

4.4 Compliance with Laws

You will comply with all applicable Australian laws and regulations when providing tutoring services, including child safety laws, Working With Children Check requirements, privacy laws, and anti-discrimination laws.

4.5 Professional Conduct

You will act professionally and appropriately in all interactions with Students and their families.

4.6 Independent Contractor

You acknowledge that you are an independent contractor, not an employee of A.C.N. 696 839 933 Pty Ltd (trading as Snappy Tutor). You are responsible for your own tax obligations, insurance, and compliance with relevant laws.

5. Student Obligations

5.1 Students and parents/guardians are responsible for conducting their own due diligence before engaging a Tutor, including independently verifying the Tutor's qualifications, WWCC status, and suitability. A WWCC badge on a tutor's profile is self-declared and has not been independently verified by Snappy Tutor. An ID Verified badge confirms identity only, not suitability.

5.2 Students must treat Tutors with respect and professionalism.

5.3 Students under 18 must have parental or guardian consent to use this platform.

6. Subscriptions and Payments

6.1 Snappy Tutor offers paid subscription plans (Basic and Premium) for Tutors. Subscription fees are charged monthly via Stripe.

6.2 You may cancel your subscription at any time via the Stripe Customer Portal accessible from your Account Settings. Upon cancellation, you will retain access to your paid plan until the end of the current billing period, after which your account will revert to the Free plan.

6.3 Subscription fees are non-refundable except where required by Australian Consumer Law.

6.4 We reserve the right to change subscription pricing with 30 days' notice to existing subscribers. Continued use after the notice period constitutes acceptance of the new pricing.

6.5 The one-off $5 AUD ID verification fee is non-refundable once the verification process has been initiated, regardless of the outcome.

6.6 All prices are in Australian Dollars (AUD) and are inclusive of GST where applicable.

7. Limitation of Liability

7.1 To the maximum extent permitted by Australian law, A.C.N. 696 839 933 Pty Ltd (trading as Snappy Tutor) will not be liable for:

• Any injury, harm, loss, or damage arising from interactions between Students and Tutors
• The accuracy or completeness of any Tutor's profile information including WWCC declarations
• The quality or outcome of any tutoring services
• Any loss of data, revenue, or opportunity
• Any indirect, consequential, or special damages
• Any harm arising from a Tutor not holding a valid WWCC

7.2 Where liability cannot be excluded under Australian Consumer Law, our liability is limited to the resupply of the relevant service or the cost of having the service supplied again.

7.3 Snappy Tutor's total liability to you in any circumstances will not exceed the total fees paid by you to Snappy Tutor in the 3 months preceding the claim.

8. Child Safety

8.1 Snappy Tutor takes child safety seriously. We require all Tutors working with minors to self-declare that they hold a valid WWCC. However, we do not independently verify this declaration. Parents and guardians should independently verify a tutor's WWCC status before allowing their child to be tutored.

8.2 If you have concerns about the safety of a child, contact the relevant authorities immediately:

8.3 Snappy Tutor reserves the right to immediately suspend any account where child safety concerns are raised.

8.4 Any suspected child abuse must be reported to the police immediately. A.C.N. 696 839 933 Pty Ltd (trading as Snappy Tutor) will cooperate fully with any law enforcement investigation.

9. Privacy

9.1 We collect and handle personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988.

9.2 We do not sell your personal information to third parties.

9.3 By using Snappy Tutor, you consent to us contacting you via email regarding your account and platform updates.

10. Intellectual Property

10.1 All content on the Snappy Tutor platform, including logos, design, and code, is owned by A.C.N. 696 839 933 Pty Ltd (trading as Snappy Tutor).

10.2 Tutors retain ownership of their profile content but grant Snappy Tutor a licence to display it on the platform.

11. Account Suspension and Termination

We reserve the right to suspend or terminate any account at our sole discretion, including where:

• False or misleading information has been provided
• A Tutor's WWCC self-declaration is found to be false
• Child safety concerns are raised
• These Terms of Service are breached
• Behaviour is deemed inappropriate or harmful
• Subscription fees are not paid

12. Disputes Between Tutors and Students

12.1 Snappy Tutor is not responsible for resolving disputes between Tutors and Students.

12.2 Any dispute arising from a tutoring arrangement is between the Tutor and Student directly.

12.3 If you have a complaint about a Tutor, please contact us at [email protected] and we will review whether any action is appropriate under these Terms.

13. Changes to Terms

We may update these Terms of Service at any time. Continued use of the platform after changes constitutes acceptance of the new terms. We will notify registered users of material changes by email.

14. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
